These terms and conditions apply to all supplies of the services by The Emotions Lab and supersede any previous terms and conditions
Definitions and Interpretation
The following terms shall have the following meanings:
“Attendees” means the staff nominated by you who will attend the online course(s)
“Contract” means the contract for the provision of an online course as set out in correspondence between us and you and these Conditions.
“Materials” means workshop materials or any other materials provided by us in written and/or digital format and/or access to live, video and online materials.
“Services” means workshops or provision of materials supplied by us to you
“We”, “us: and “our” refers to The Emotions Lab, 92 St Andrews Road, Henley on Thames, RG91PL.
“You” means the school or organisation to whom we have agreed to provide the workshop(s) or who is accessing any other service or materials from us.
- When these Terms apply
1.1. The Terms shall apply on the earliest occurrence of any of the following:
- booking any of our online course or
• receiving any of our Materials;
• receiving any other course-related services or Materials;
• making payment to us;
• attending or viewing any of our courses.
1.2. You agree that these Terms will form part of any contract you enter into with us.
1.3. The Services will be supplied under a legally binding contract which will consist of these Terms (as amended from time to time) plus any terms set out in correspondence between us.
- Provision of Workshops
2.1 We shall provide online course(s) and associated materials to you subject to these Conditions.
2.2 We may, at any time, without notifying you make any changes to courses and materials which are necessary to comply with any applicable statutory requirements, or which do not materially affect the nature or quality of the service we offer.
- Fees and Charges
3.2 All fees quoted to you for the provision of the course(s) or materials are exclusive of any Value Added Tax, for which you shall be additionally liable at the applicable rate from time to time.
3.3 Our fees shall be paid through online purchase
- Your obligations
4,1 Venue and equipment
You will be responsible for organising a suitable venue with access to training equipment such as laptop, wi-fi for yourself.
4.2 Attendees
You will be responsible to ensuring that you attend the course. Login in details must not be shared.
4.3. GDPR/Data Protection
You should not provide us with any personal information about you, your staff, attendees, children or any other individuals,.
You will be solely liable for upholding data subject’s rights in relation to the processing of Personal Data, specifically their rights of access, right to request rectification and/or erasure and if necessary, the right to object to processing.
- Our obligations
5.1 Reasonable care and skill
We warrant to you that the course(s) and materials will be provided using reasonable care and skill.
5.2 GDPR/Data Protection
We ask that you do not provide personal information about you or any individuals in any correspondence. We warrant that it shall comply with all of its obligations under the Data Protection Requirements which arise in connection with our Services, or our performance of our obligations, and that it shall not, in respect of any Personal Data processed, do any act or make any omission which puts you or us in breach of its obligations under the Data Processing Requirements.

6.1 Educational and information purposes only.
The information provided in or through our courses, website or materials is for educational and informational purposes only.
6.2 Not medical or mental health advice.
We are not, nor are we holding ourselves to be doctors/physician, nurses, physician's assistants, advanced practice nurses, or any other medical professionals ("Medical Provider"), psychiatrists, psychologists, therapists, counsellors, or social workers ("Mental Health Provider"), or member of the clergy or teachers. We are not providing health care, medical or therapy services, or attempting to diagnose, treat, prevent or cure any physical, mental or emotional issue, disease or condition. The information provided in our workshops or other materials is not intended to be a substitute for the professional medical advice, diagnosis or treatment provided by your own Medical Provider or Mental Health Provider. You agree and acknowledge that we are not providing medical advice, mental health advice, or religious advice in any way.
6.3 No Guarantees
Our role is to support and assist you in the application of tools to promote well being in schools and at home, but your success in implementing our tools depends on your own effort, motivation, commitment and follow-through and a range of other factors outside of our control. We cannot predict and we do not guarantee that you will attain a particular result, and you accept and understand that results differ for each individual and each school. Each individual's results depend on his or her unique background, dedication, desire, motivation, actions, and numerous other factors. You fully agree that there are no guarantees as to the specific outcome or results you can expect from using the information you receive from us.
- Liability
7,1 Limitations of our liability
Except in respect of personal injury caused by our negligence, or as expressly provided in these conditions we shall not be liable to you or any third party by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of us, our servants or agents or otherwise) which arise out of or in connection with the provision of the service or their use by you, and the entire liability under or in connection with the Contract shall not exceed the amount of our fee and charges for the provision of the service, except as expressly provided in these conditions.
7.2 We shall not be liable to you or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the contract, if the delay or failure was due to any cause beyond our reasonable control.
- Copyright
8.1 All our products, and materials including but not limited to designs, concepts, videos, presentations, booklets, merchandise, logos, and intellectual property, are protected by copyright law.
8.2 Any reproduction, distribution, or unauthorized use of our products or their components is strictly prohibited without prior written consent from us. Any infringement of our copyright will be legally actioned.
